Abstract
The ability to exchange information between all relevant authorities that have a role in resolution, subject to appropriate safeguards to protect the confidentiality of non-public information, is fundamental to coordinated and effective planning, preparation and implementation of resolution. The Key Attributes stipulate that resolution authorities should have the power to exchange information necessary for recovery and resolution planning or implementing a coordinated resolution with foreign authorities (KA 7.6), and that there should be no legal, regulatory or policy impediments under jurisdictions’ legal frameworks that hinder the appropriate exchange of such information with both domestic and foreign authorities (KA 12). Jurisdictions are also required to have in place confidentiality requirements and statutory safeguards for the protection of information received from foreign authorities (KA 7.7).
